Privacy Policy for Netzero

This Privacy Policy explains how Netzero Labs, Inc. ("Netzero", "we", "us", or "our") collects, uses, shares, and protects personal data when you use the Netzero mobile and web applications ("the App") and related services available at https://app.netzero.energy and https://www.netzero.energy, including the developer API and email support.

By using the App, you agree to this Privacy Policy. If you do not agree, please stop using the App.

1. Data We Collect

We collect information necessary to provide, improve, and secure the App and its services.

a. Account and Contact Information

  • You sign in with your Tesla account. We receive your Tesla user ID, the email address on your Tesla account, and the list of Tesla products on the account (energy site IDs, vehicle identification numbers (VINs), and the names you gave them).
  • The email address you choose for notifications, if different.
  • Subscription details such as plan, trial, renewal, or cancellation status.
  • We never see or store your Tesla password. Sign-in happens on Tesla's own website.

b. Location Data

  • The location you enter for your home (typically a city), which we convert into approximate coordinates, time zone, and elevation for solar forecasts, weather, and tariffs.
  • We do not collect GPS location from your phone or your vehicle. For vehicle charging features we only receive a yes/no indication of whether the vehicle is at home.
  • On iOS, the App may ask for location permission only because iOS requires it to join your Powerwall's Wi-Fi network. It is not used to read your location.
  • We use your IP address to guess your country for the website, but we do not store the result.

c. Energy and Device Data

  • Data from connected devices such as solar generation, home consumption, grid import/export, battery charge or discharge, and backup events.
  • Configuration of your energy system, such as backup reserve, operating mode, grid charging and export settings, tariff, and virtual power plant (VPP) program events.
  • Diagnostic data such as firmware versions, battery capacity and health, device serial and part numbers, solar string readings, alerts, and error codes, whether retrieved through the Tesla cloud or read by the App from your Powerwall on your local network.
  • Vehicle and charger data such as VIN, state of charge, charge limit, charging power and energy, charging state, software version, and charger model and meter readings, from Tesla, Enode, or chargers you connect to us over OCPP.
  • Data from other integrated devices such as thermostats or heat pumps, when connected through Enode.
  • Automations you create and the results of running them.
  • If you use the App's local Powerwall connection, the gateway Wi-Fi password and login you enter or scan are stored only on your device and are not sent to us. If you pair the App with your Powerwall, we generate and store a pairing key that lets us send signed commands to it.

d. Utility and Tariff Accounts

  • If you connect an energy supplier account (for example Octopus Energy, Amber Electric, or Tibber), the API key and account number you provide, along with account details we retrieve from the supplier such as meter point numbers, tariff agreements, smart device dispatches, and event programs.

e. Subscription and Payment Data

  • We receive non-sensitive payment metadata (plan, renewal status, transaction or purchase IDs) from payment processors such as Apple, Google, or Stripe.
  • We do not collect or store your credit card or payment credentials.

f. Device, Usage, and Diagnostics Data

  • A random identifier for each installation of the App.
  • Technical information such as device model, operating system and version, App version, time zone, language, screen size, and App preferences.
  • On Android, the install source reported by Google Play (for example, the website or campaign that led to the install). We do not store advertising IDs or ad click IDs.
  • Crash reports, error reports, and server logs, which may include your user ID, site ID, and IP address.
  • On Android, Google Firebase Analytics collects basic App usage events and device information.

g. Communication Data

  • Support emails and their attachments, feedback, and correspondence history when you contact us.
  • Push notification tokens and email addresses for sending App, account, and alert notifications.
  • Records of the emails we send you and whether they were delivered.

h. Developer API and Data Exports

  • If you create a developer API token, the token and the requests made with it.
  • Data export files you request, which we generate and store so you can download them.

2. Purpose of Processing

  • Provide, operate, and improve the App and its services, including running your automations and sending commands to your devices.
  • Manage your account, authentication, and subscription.
  • Monitor your system and notify you about outages, alerts, and automation results.
  • Diagnose and resolve technical issues, and respond to support requests.
  • Communicate with you about account activity, updates, and changes, and (where you have not opted out) about new features.
  • Understand how people find and use the App, so we can improve it.
  • Develop new features and improve performance.
  • Protect the App and its users against fraud, abuse, and security threats.
  • Comply with legal obligations such as tax reporting and fraud prevention.
  • Produce aggregated, anonymized analyses of system performance, battery health, and energy usage.

3. Legal Basis for Processing (GDPR Article 6)

  • Contract performance: to provide the App and its features, including subscriptions and support.
  • Consent: when you explicitly allow certain processing (for example, push notifications or connecting a third-party account).
  • Legitimate interests: for analytics, diagnostics, security, product update emails, and feature improvements that do not override your privacy rights.
  • Legal obligation: to comply with tax, accounting, or regulatory requirements.

You can withdraw consent at any time from within the App or by contacting info@netzero.energy.

4. Emails and Notifications

  • We send service emails and notifications about your account, subscription, system alerts, and automations. You can turn off most notifications in the App's settings.
  • We may also send occasional emails about new features and product updates. Every such email includes an unsubscribe link, and you can change this preference in the App.

5. How We Share Data

  • We do not sell personal data.
  • We share data with service providers who help us operate the App (listed in section 6). They are contractually bound to process data only on our behalf and according to this Privacy Policy.
  • When you connect a device or account (such as Tesla, Enode, or an energy supplier), we exchange data with that provider as needed to provide the features you use, including sending commands you or your automations request.
  • Data may be disclosed if required by law, to protect our rights, or to prevent misuse or fraud.
  • If Netzero is involved in a merger or acquisition, user data may be transferred to the new entity under equivalent privacy safeguards.

6. Third-Party Services

The App relies on the third-party services below. Services you connect yourself have their own privacy policies that govern how they collect, use, and disclose your data, and we are not responsible for their data practices.

7. Data Retention

  • We keep personal data while your account is active or as required for legal compliance.
  • After account deletion, personal data is removed or anonymized.
  • Aggregated data may be retained indefinitely as it cannot identify individuals.
  • Diagnostic logs may be kept up to 12 months for performance analysis.

8. Data Deletion and Portability

  • You can delete your account at https://www.netzero.energy/delete_account.
  • After deletion, personal data and associated identifiers are removed.
  • You can request an export of your personal data by emailing info@netzero.energy.
  • Aggregated data already anonymized will not be deleted, as it contains no identifiable information.

9. Your Rights (GDPR and CCPA)

Under GDPR (EU/UK)

  • Right of access: obtain a copy of your personal data.
  • Right to rectification: correct inaccurate or incomplete data.
  • Right to erasure ("right to be forgotten"): request deletion of your data.
  • Right to restriction: limit processing under certain conditions.
  • Right to data portability: receive your data in a machine-readable format.
  • Right to object: object to processing based on legitimate interests, including product update emails.
  • Right to lodge a complaint: contact your national data protection authority.

Under CCPA/CPRA (California, USA)

  • Know what categories of personal information are collected and for what purposes. The categories are described in section 1: identifiers, commercial information (subscriptions), approximate location, internet or other electronic activity (usage and diagnostics), and energy and device data.
  • Request deletion of personal data.
  • Request access to specific pieces of data collected.
  • Request correction of inaccurate personal data.
  • Opt out of data sale or sharing (Netzero does not sell or share data for advertising).
  • Not be discriminated against for exercising privacy rights.

You may exercise these rights by contacting info@netzero.energy. We may need to verify your identity, for example by confirming the email address on your account.

10. International Transfers

Your data is stored and processed in the United States, and some of our service providers may process it in other countries. When required by law, we use Standard Contractual Clauses or other safeguards to protect data transferred from the EU or UK.

11. Security

We use technical and organizational measures to protect your data, described in our Security Policy. No system is completely secure, and we will notify you and the relevant authorities of a data breach where required by law.

12. Paid Subscriptions

  • Subscription data is processed via Apple, Google, or Stripe according to their respective privacy policies.
  • We retain only metadata needed for entitlement verification, tax compliance, and support.
  • Cancellation or payment failure will stop access to paid features but not affect free account usage.
  • We may notify users of subscription or pricing updates by email or within the App.

13. Automated Decision-Making

Your automations control your devices based on rules you configure. Netzero does not use automated decision-making or profiling that produces legal or similarly significant effects on users.

14. Children

The App is not directed to children under 16, and we do not knowingly collect personal data from them. If you believe a child has provided us with personal data, contact us and we will delete it.

15. Changes to this Policy

We may revise this Privacy Policy as needed. The latest version will always be available at https://www.netzero.energy/privacy with the "Last Updated" date. Continued use of the App after changes constitutes acceptance.
